AGBs.

1. Scope / General

www.amourdesanges.ch is the online shop of Ankh & more GmbH. These General Terms and Conditions (hereinafter referred to as T&Cs) apply to all services provided by www.amourdesanges.ch. By placing an order, the customer expressly agrees to these T&Cs, which apply to all services of the online shop (www.amourdesanges.ch) of Ankh & more GmbH. Ankh & more GmbH reserves the right to amend the T&Cs applicable to www.amourdesanges.ch at any time. Such changes take effect immediately upon publication.
 

2. Products and Offers

The entire range of products on www.amourdesanges.ch is non-binding. Ankh & more GmbH strives to provide accurate product descriptions; however, these may differ from the manufacturer's descriptions. Ankh & more GmbH assumes no liability for the accuracy, completeness, or timeliness of these descriptions. In any case, the customer is required to review the specific product information on the product packaging before use. Product images and illustrations on www.amourdesanges.ch may differ from the original and are not color-binding.
 

3. Prices

The product prices listed on www.amourdesanges.ch at the time of the customer's order are binding. If there is an error in the price information, Ankh & more GmbH reserves the right to make price adjustments retroactively. In such cases, the customer will be informed and may withdraw from the purchase within the period set by Ankh & more GmbH. All prices are in Swiss Francs (CHF), including VAT, and exclude shipping costs unless otherwise stated. Products are generally shipped via our shipping partners, Swiss Post. Shipping costs may vary depending on the order value and are to be borne by the customer unless otherwise stated.


4. Registration

Registration on www.amourdesanges.ch is reserved exclusively for individuals who are fully legally competent. By placing an order, the customer guarantees that they are at least 18 years old, not incapacitated, and legally competent. There is no entitlement to admission to the online shop. The data required for registration must be provided by the customer completely and truthfully. The customer is responsible for keeping their data up to date.
 

5. Orders / Conclusion of Contract

The customer's order becomes binding only when it is confirmed by Ankh & more GmbH via email. Ankh & more GmbH reserves the right not to confirm an order without providing reasons. By placing an order, the customer confirms the accuracy of all information provided. If the customer's information is incorrect or incomplete, Ankh & more GmbH may withdraw from the contract. Ankh & more GmbH also reserves the right to withdraw from the contract if the products are not available from the manufacturer. In such cases, Ankh & more GmbH will endeavor to find an alternative solution in consultation with the customer. If the customer does not require an alternative, no further rights or obligations will exist between the two parties.


6. Delivery

Ankh & more GmbH maintains a large inventory of products. Orders placed and confirmed by 6:00 PM will be delivered to customers within 1-3 business days. If certain items are not in stock, the shipping time may be delayed depending on the manufacturer's delivery times. Delivery times are always non-binding, and delivery delays do not entitle the customer to claim damages or withdraw from the contract. The customer is required to inspect the delivery immediately upon receipt and return incorrect or defective deliveries to Ankh & more GmbH within 14 days. Products not returned for these reasons will be invoiced. Ankh & more GmbH delivers exclusively to the geographical areas of Switzerland and Liechtenstein.


7. Transfer of Risk

The risk passes to the customer as soon as the shipment is handed over to the transport company. If the shipment is delayed or becomes impossible without fault on the part of Ankh & more GmbH, the risk passes to the customer upon notification of shipping readiness. An agreement to cover shipping costs by Ankh & more GmbH does not affect the transfer of risk.


8. Payment Methods

Customers can pay via PayPal, credit card (MasterCard, Visa), Postcard, prepayment, or TWINT. Payment is always processed using secure SSL encryption technology.

8.1 Invoicing by Ankh & more GmbH

If Ankh & more GmbH acts as the invoicing party, it reserves the right to charge reminder fees of up to CHF 30 per reminder for overdue payments to partially cover incurred costs. Reminders may be sent via email, in writing, or by phone. If reminders are unsuccessful, Ankh & more GmbH may transfer the claim to a third-party debt collection agency or initiate legal proceedings. The debt collection agency may, like Ankh & more GmbH, impose additional processing and collection fees.


9. Retention of Title; Offsetting; Right of Retention

For consumers, we retain ownership of the purchased goods until the invoice amount is fully paid. For businesses, public legal entities, or public-law special funds, we retain ownership until all outstanding claims from the business relationship are settled. The corresponding security rights are transferable to third parties.
You are entitled to offset only if your counterclaims are legally established, undisputed, or acknowledged by us. You also have a right of retention only if your counterclaim is based on the same contractual relationship.
If the customer is in default of any payment obligations, all existing claims become immediately due.


10. Quantity Restrictions

Ankh & more GmbH reserves the right to limit the delivery quantities for certain products.

11. Return Policy / Right of Withdrawal

We grant a return right for products purchased from us within 14 days of receipt, provided the safety seal is intact and the product has not been opened. The date of dispatch of the goods is decisive for meeting the deadline. Returned products or packages will only be accepted in proper condition, i.e., undamaged, unused, unopened, and in their original packaging. We will cover the return shipping costs by providing a free return label upon request. The return label can be requested via email at info@amourdesanges.ch.

The customer is responsible for packaging the goods for return in a transport-safe manner. Damages or loss of goods due to improper packaging will be charged to the customer. If the customer hands over the goods to a transport company, the customer bears the risk for the safe transport of the goods. The risk passes to Ankh & more GmbH only upon receipt of the goods.

If a gift (GWP = gift with purchase) is included with an order above a certain purchase value, restrictions apply in the event of a return. If the entire order is returned or the new purchase value falls below the threshold for the GWP, the gift must also be returned. If the gift is not returned under these circumstances, the value of the gift will be charged.

Incompatibilities or Allergies

Ankh & more GmbH assumes no liability for any allergic reactions or their consequences. If allergic reactions occur after using a product, this must be reported by the customer within one month of purchase (via email or phone) to determine the next steps. In any case, it is recommended to document the allergic reaction with photos and/or obtain a medical certificate or allergy pass.
 

12. Warranty

The warranty provisions of the product suppliers apply. These are included with the products. Ankh & more GmbH does not provide any additional warranty. In any case, the customer is required to contact Ankh & more GmbH to clarify the type of warranty processing. The supplier has the sole discretion to determine the type of warranty service in the event of a warranty claim. For devices, the possibility of repair will always be considered first. Warranty services are exclusively available to the customer and are non-transferable. Damages resulting from improper handling, natural wear and tear, or external influences not attributable to the seller are the customer's responsibility and do not constitute a warranty claim.


13. Notification Period for Defects

Defects must be reported in writing within 14 days of receiving the goods. Otherwise, the goods are considered flawless and accepted by the customer.
 

14. Transport Damages

Transport damages must be reported in writing within 5 days to both Swiss Post/Quickpac and Ankh & more GmbH. The risk of transport damages lies with the customer unless it can be transferred to the carrier.


15. Data Protection

The provisions of our privacy policy, which form an integral part of these T&Cs, apply to data protection.

16. Liability

To the extent permitted by law, Ankh & more GmbH excludes all liability for damages and consequential damages (e.g., due to accidents and/or injuries caused by products distributed by Ankh & more GmbH) to the customer. In no case do breaches of contract, impossibility of performance, pre-contractual negligence, or tortious acts give rise to claims for damages or a right to withdraw from the contract.

A liability claim must be reported in writing to EMAIL within 20 days of the dispatch of the goods (handover of the shipment to the commissioned transport company); otherwise, any claim will expire.


17. Applicable Law / Jurisdiction

The contract is exclusively subject to Swiss Obligations Law and other regulations issued by Swiss legislation.

The place of jurisdiction for all disputes with Ankh & more GmbH is – subject to mandatory federal legal jurisdictions – Zurich, Switzerland.
